1. The Marketplace Platform
Influenced provides a digital marketplace platform that facilitates connections between brands ("Brands") and content creators ("Influencers"). By using our services, you acknowledge that Influenced is a facilitator and not a party to any agreements made between Brands and Influencers.
No Employment Relationship: Influenced is not an employer, employment agency, or labour hire firm. Influencers act as independent contractors. Influenced does not verify work rights, tax status, or legal compliance of its users. It is the sole responsibility of the hiring Brand to ensure all collaborations comply with relevant Australian and New Zealand laws, including but not limited to the Fair Trading Act (NZ), Competition and Consumer Act (AU), and relevant tax obligations.
2. Intellectual Property & Usage Rights
Creator Ownership: Unless explicitly stated otherwise in a Campaign Brief or Booking Agreement, all intellectual property rights in the content produced by an Influencer (the "Work Product") belong exclusively to the Influencer.
Usage & Licensing: The specific usage rights, duration (e.g. 12 months, perpetual), and exclusivity (e.g. non-exclusive, full buyout) for the Work Product are governed by the terms set out in the specific Campaign Brief or Booking Agreement within the platform.
Default Licence: In the absence of specific terms in the Campaign Brief or Booking Agreement, upon successful payment of the agreed fee, the Influencer grants the Brand a non-exclusive, worldwide, royalty-free licence to use the Work Product for the Brand's specified marketing purposes on social media and digital platforms for a period of 12 months.
Influenced Platform Licence: By uploading any material (including profile images, portfolio items, or campaign content) to the site, you grant Influenced a non-exclusive, irrevocable, perpetual, worldwide, royalty-free licence to use, reproduce, modify, and display such material for our own marketing and promotional purposes across any media or channel.
3. Payments & Escrow
Influenced uses a secure escrow system to protect both parties. Brands must pay the total campaign fee upfront. These funds are held securely by Influenced and are only released to the Influencer once the Brand has approved the submitted work or the review period has elapsed without dispute.
Influenced charges a service fee for facilitating these transactions. All prices are listed in New Zealand Dollars (NZD) unless otherwise specified.
4. Creator Referral Program
Eligible creators may invite other creators to Influenced using a unique referral link. When a creator you refer signs up through your link and completes Stripe onboarding (becoming able to receive payouts), you receive $30 of referral credit in your payout currency (NZ$30, or A$30 for creators paid in Australian dollars). Referral credit is a fee credit only — it is automatically applied to reduce the platform service fee on your future bookings. It has no cash value and cannot be withdrawn, transferred, or redeemed for cash, and it is not a payment, rebate, or deposit.
Referral credit is subject to a lifetime cap of $300 in your payout currency per creator; any credit earned above the cap is held and released automatically as you spend down your balance. Unused credit expires 12 months after it is granted. Credit is granted only for genuine, first-time referrals — self-referrals, duplicate or fraudulent sign-ups, and any attempt to manipulate the program are not eligible. Influenced may withhold, reduce, reverse, or expire referral credit, and may modify or discontinue the referral program, at any time at its sole discretion.
5. Dispute Resolution
We encourage Brands and Influencers to resolve any issues directly through our internal messaging system. If a resolution cannot be reached, either party may initiate an internal dispute resolution process by clicking the "Support" button within the campaign workspace or contacting hello@influenced.co.nz.
Influenced reserves the right to make a final, binding decision on the release or refund of escrowed funds based on the evidence provided (e.g., chat logs, campaign briefs, and submitted work).
6. User Conduct & Content Moderation
Users must provide accurate information. Influenced maintains a zero-tolerance policy for objectionable content or abusive behavior.
User-Generated Content (UGC) Policy: You agree not to upload, post, or share any content that is defamatory, obscene, harassing, threatening, or otherwise objectionable. We reserve the right, but are not obligated, to monitor, review, or remove any content at our sole discretion.
Safety Measures: The platform provides mechanisms for users to flag objectionable content and block abusive users. We will investigate all reports within 24 hours. Confirmed violations of these terms may result in immediate content removal and account termination.
Circumvention: Any attempt to circumvent the platform (e.g., taking payments off-platform) will result in immediate termination of your account.
7. Limitation of Liability
To the maximum extent permitted by law, Influenced shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the platform or any collaborations formed through it.
